Only Solutions offers experienced and professional Early Neutral Evaluations to help support disputes early in the litigation process. Early Neutral Evaluations are one of three processes available in alternative dispute resolutions (the others being mediation and arbitration). Like mediation, Early Neutral Evaluations are confidential and non-binding and may even evolve into mediation if all party's jointly choose to proceed that way. We provide Early Neutral Evaluations either in person or through remote sessions.
Our goal is to provide our clients with experienced legal voices who will serve as neutrals to objectively assess the strength and weaknesses of each party's position and offer an evaluation based on the anticipated evidence and applicable legal principles. We also offer recommendations for a framework in which the dispute can be resolved, the likely outcomes as well as the value of the case.
Only Solutions ADR also offers mock jury evaluations, bringing in voluntary law students to sit in the Early Neutral Evaluation process in order to act as a jury would in a public proceeding. This is useful for those who want to go into the litigation process more confident of an impartial verdict having had the foreshadowing experience of their cases presented to a mock jury.
What exactly is an Early Neutral Evaluation? ENE's are a form of alternative dispute resolution that is similar to mediation in which an impartial third party gives their advice on a case. ENE's are non-binding and are frequently used by party's preparing for the litigation process who would like an experienced legal voice to evaluate their case along with its strength and weaknesses. Early Neutral Evaluations bring clarity to cases along with the opportunity to focus on the most important issues of a case for each party.
Typically, cases in family law are intensely personal by nature. By allowing a third-party neutral expert to access the merits of a case allows each party to come to a clear understanding of the central issues in a dispute. In a way, it is a "reality check" for all party's involved.
Early Neutral Evaluations are voluntary, non-binding and educational. This means that party's are not required to settle at the end of an evaluation. They are simply equipped with expert opinions of their cases.
